Case 2003 039 141

Document Number 6313 version 1

9th Document by Jackie Blystone.

Notice of Interlocutory Appeal to the Court of Appeal

I hereby request the clerk to certify a record for appeal.

I request a copy of the transcripts of the several court sessions,

Notice of Interlocutory Appeal to the Court of Appeal

To all parties: I, Jackie Blystone, hereby notify this trial court of my appeal to the California Court of Appeal at 200 East Santa Clara. I am appealing the interlocutory orders and unconstitutional actions of this trial court.

Although the law does not require me to address issues in my notice of appeal, here are the issues.

1.         Judge Roland Purnell refused to permit me to continue to appear pro se. He did not conduct a hearing. He called me incompetent without having a hearing to do so. After I had already demurred he accepted a “not guilty” plea made within seconds of appointment of a lawyer who looks like Colonel Sanders. I am not sure of his name. May be Perry or Perryman.

2.         The clerk refused (without written reason, appearance at the window, or even self-identification) to file my Notice of Appeal to the appellate department.

3.         Judge Purnell ignored my written request for a discovery order and my proposed discovery order attached to my motion #6279. . He refused to read it. He refused to permit the clerk to file it. He called me incompetent and refused to even read my motion #6279. My motion #6279 was pursuant to PC 1054.5b. I was merely asking for discovery items pursuant to statute.

4.         He foisted upon me an incompetent public defender against my will in violation of Faretta.
