1. On April 2 I file a demurrer. I have a filed stamped copy with me. It is likely not in the court file because the file has been in court 11 and not upstairs.
2. On April 1 I filed a motion to suppress evidence. I have a file-stamped copy with me. It is likely not in the court file because the file has been in court 11 and not upstairs.
3. I plan to file 2 more motions today:
a. A discovery motion.
b. Another motion.
4. I would like to continue this arraignment 2 more weeks, if possible, so that my candidate(s) for my lawyer can discover what this case is about before they make a decision in my case.
5. I saw the complaint in my case for the first time only 3 days ago.
6. I am asking to continue this arraignment for 13 more days.
Declaration of Defendant regarding attempt to hire a lawyer with no discovery.
I, Jackie Blystone, declare the following under penalty of perjury: I cannot explain my case to a lawyer because I have no police reports or any “discovery” at all. That is why I ask for two more weeks. This case is on schedule.
On March 29 I appeared at the district attorney office. The woman there told me to call 654-3007, the discovery unit but they close at 1. The next day I called Celia in discovery. She told me that my discovery papers had been sent to the public defender. I therefore drove to the Public Defender office. Delores there told me that my file there was empty. On Tuesday, 3 days ago, I asked Sue, the records clerk, for a look at my file. Sue said that the file was down in court 11 and that she could not give me a copy of my complaint. I talked to a supervisor who told me to come back in a couple hours. I did come back in a couple hours and I did indeed see my complaint for the first time. I need more time. This motion is not made for the purpose of delay; indeed I have moved forward on this case.
