1.         Instrument of Oppression: Failure of the court to deliver a transcript to you is oppressive! Remedy: Today you have a right to an e-transcript! See California rule of court rule 4f4. Accept no substitute. Demand that the court stop until they catch up with the transcript. That is what we did in Charlie’s case! Simpson got his trial transcripts that same day! Demand the O.J. standard in all things!

2.         Instrument of oppression: The clerks sometimes refuse to file/ accept/ stamp your motion. Remedy: Take names. Ask for a refusal in writing. Apply to the court for a writ of mandate. I can help you with this. The clerks have no right to refuse your written motion even if you have a public defender. Also, you can mail your motions o the court from jail and/or from home. The proof of service is for YOU to show the judge - and to prove to the clerk that you served the prosecutor if necessary. In a motion to quash it is not necessary to serve the prosecutor; there is none.

3.         Elimination of mens re using crimes of possession (of drugs) non-possession (of bogus driver license) and their inherent strict liability is oppressive and new. My remedy: demurrer, motion to quash.

4.         Refusing to permit you to be released O.R. is oppressive. Holding you on excessive/ unworkable bail until you plead guilty is oppressive and unconstitutional. They did this to Nick Tilberg, to Ron Fox, to me, and to thousands of folks every day! My remedy: PC 1318 motion and the specific O.R. statute in each state. Sometimes it is called P.R. Ron Fox found the 180 day rule in Michigan and wrote his way out of jail while his appointed lawyer did not know how to do it.

5.         Offering a plea to a lesser offense when there is no factual basis is oppressive. This is standard procedure every day in every court in America! That is what they did in the Ron Fox case: http://www.lawyerdude.s5.com/ignace.html

6.         If you are paying the bill then you have a right to the lawyer of your choice. Lawyers are not fungible! http://www.lawyerdude.netfirms.com/choice.html The Supreme Court addressed that issue in 2006.

7.         Jamming you up by not giving you your requested 4 week continuance is oppressive. Another tactic is ordering that your motions be heard on the morning of your trial. Remedy: remind the court of the O.J. standard. We never heard Judge Lance Ito say to Johnny Cochran that O.J.’s motion would be heard on the morning of trial. Having watched the O.J. trial and the Michael Jackson trial we all know now how real trials work. Demand the O.J. standard!

8.         Public Defenders are instruments of oppression. They are sales agents for the prosecutor ! They are not required to write anything! Even if they sleep during your trial the courts have held that it is okay! Demand my new standard of performance! http://www.circuitlawyer.8m.com/5635.html

9.         Failure of the court to inform you of all your rights is oppressive. In particularly they don’t tell you about your right to demur in California - or anywhere!

10.       Probation is oppressive. It is a device to take away your right to resist searches. It imposes unconstitutional duty to report. Probation officers are oppressive. They are uneducated officers - as in “He has erected a multitude of New Offices, and sent hither swarms of Officers to harass our People, and eat out their substance.” Recognize that? It is a quote from the Declaration of Independence. Lawyedude fell prey to the probation trap. They institute a probation revocation hearing which deprives you of our right to a jury.

11.       Statutes of limitation are oppressive. Congress assigned no statute of limitations to Section 1983 and the federal courts borrow from state law; this instrument of oppression may eventually go away - if you make it go away.

13.       You have a right to have your time tolled in civil cases while you are in jail.

14.       Depublication rules which violate stare decisis. Overreaching rules by Judicial Councils. Remedy: Legislation and litigation. The internet makes this problem moot!

23.       Legal Fictions. There are lots of legal fictions. They are used to protect those in power and to steal from the poor.

24.       Splitting off one section and renaming it without dragging along the accouterments. Example from Debra: The Wyoming constitution designates a bunch of criminal procedure rights and so does its legislature. Then the legislature created a new set of local traffic courts and tried to give them less rights. Another example is “felony dilution” The legislature designates certain punishments for felonies. Then the legislature upgrades a bunch of misdemeanors to felonies. That is ex post facto and changing the rules in the middle of the game.

25.       Changing the meaning of words. Example: the trend in the law is for the legislature to turn many misdemeanors into felonies. I call this dilution of the felony stigma. The problem arises upon the application of second tier laws that are triggered by the commission of a felony. The legislature never did intend for those second tier laws to be triggered for this misdemeanor. This is very bad law. Example: Disbarment for committing a felony. Practicing law without a license has been elevated to a felony - but only for real lawyers - not for high school dropouts. Now the lawyer wants to re-apply and he is hit with a felony stigma for having committed with amounts to a misdemeanor for non lawyers. Here is what the Supreme Court says about that in Craig v Missouri (1830) 29 U.S. 410, 433

Chief Justice Marshall: “Is the proposition to be maintained, that the constitution meant to prohibit names and not things? That a very important act, big with great and ruinous mischief, which is expressly forbidden by words most appropriate for its description; may be performed by the substitution of a name? That the constitution, in one of its most important provisions, may be openly evaded by giving a new name to an old thing? We cannot think so.” - Chief Justice Marshall in 1830 in Craig v Missouri (1830) 29 U.S. 410, 433 http://laws.findlaw.com/us/29/410.html26.       Taking your video camera and tape recorder at the metal detector and otherwise refusing to permit you to tape record your case.

50.       Changing the meaning of well known words, like felony, and thereby changing the law retroactively. This is unconstitutional. It is ex poste fact. The bar does it. It predicates certain punishments on the commission on the status of having committed a felony, but the status of felon is rapidly being eroded so that eventually at today’s pace we shall all be felons. Another example is how the IRS tries to change the meaning of “income” to include wages. It was never intended to cover wages, but by stealthy encroachment, the personal exemption grew too small, the Republicans erased the high tax brackets, and the corporations and rich all have tax shelters. Then tax becomes more regressive every day. Eventually, like today, most people mistakenly believe that the income tax applies to wage earners.

We need to stop corporations from ruining our lives. We made a mistake 100 years ago by permitting corporations to have equal protection with humans. This merely gives the wealthy capitalists an advantage over the individualists and working class. This class struggle manifests itself in various ways in the legal system. Perfidy and greed are human vices. Governments develop a psyche to mimic those who control the government. Our government has a bad personality. We must fix it by castrating corporations.

            Our totalitarian government and the military industrial complex have by stealthy encroachment created instruments of oppression. The government has taken our basic rights. It calls them "privileges" and "licenses" and sells them back to us.

            All employment is oppression. If you can't make someone a partner in your enterprise, then do it yourself. Don't pay somebody else to make your dream - unless you plan to share it.

Corollary: All home rental is oppression. Why hoard homes?

Corollary: Why hoard money. All lending is oppressive. (This theme is an old one. I found it in a 1947 book called "American Dreams".

We seek authoritative patriot stuff.

We expose scams - particularly book sellers in the patriot movement.

We urge people to take responsibility for their own litigation.

We should never reject the cause of the oppressed and defenseless.
